Victory Secured: AICL Members recover ₹3.08 Crore in Outstanding Fees amid Hospital Insolvency

For over 5-6 years, 13 dedicated doctors, all esteemed members of AICL, served as consultants at a renowned hospital. Despite their relentless efforts and unwavering professionalism, their dues—amounting to ₹3.08 crore—remained unpaid. AICL, under the aegis of experts and unparalleled commitment to its members, stepped in to safeguard the interests of its members and resorted the legal course but despite repeated requests and reminders, via legal notices the hospital authorities turned a deaf ear.

Meanwhile the hospital filed for insolvency, making the recovery more complicated, However, Acting swiftly and strategically as per the insolvency procedure under IBC, AICL guided all 13 doctors to file their claims under Form D as claims by workmen or employees within the stipulated timeframe under the Insolvency and Bankruptcy Code (IBC).

During the insolvency proceedings, the Resolution Professional of the hospital submitted a resolution plan, which received unanimous approval from the Committee of Creditors BY 100 voting. The plan was subsequently approved by the National Company Law Tribunal (NCLT), compelling the hospital to clear the outstanding professional fees owed to the 13 doctors.

This remarkable achievement showcases the power of timely action, expert legal guidance, and the unwavering support provided by AICL to its members. The collective effort resulted in the recovery of ₹3.08 crore—proving once again that AICL stands as a pillar of strength for its members, even in the face of adversity.
