Removal of kidney – to save the life of patient is not negligence.

Patient suffering from Kidney stone was operated thrice and lastly the kidney was

Removed, but no relief.

At district level Rs. 1 lacs compensation was awarded which was reversed at state

Level but patient filed appeal at National level.

National commission dismissed the appeal stating no negligence as after surgery

Patient complained for bleeding in urine and the condition of patient was life

Threating, hence the doctor performed nephrectomy which was correct decision as

There was no facility of angioembolization (a procedure in which the blood supply to a tumor or an abnormal area of tissue is blocked), proper consent was taken from patient party. Kidney was removed to save the life, hence no negligence.
