The petitioner (AICL member) filed an application u/s 438 crpc seeking anticipatory bail apprehending arrest in a police case, whereby upon a written complaint of a case was registered alleging petitioner under section 341, 323 379 364 and 34 IPC.
Facts:
The informant alleged that on 02.03.2019 she went to the clinic of petitioner where the 3compounders misbehaved with, outraged her modesty due to which she suffered injuries on head and left eye, her chain was snatched and was threatened with dire consequences.
She alleged that petitioner being the owner of the clinic did not intervene, infact tried to stop the informant from approaching the police station.Petitioners pleas that they have been are falsely implicated in this case with a motive to harass and blackmail.
The learned court held that there are no direct allegations against the petitioners regarding the commission of offence, only allegation was that they have not taken any action against the accused. Hence the anticipatory bail petition was allowed.
Further no offence was made against the petitioners in the final report submitted.
