How Doctors Can Choose a PI Policy That Actually Helps During Medico-Legal Trouble

You only discover how useful your PI policy is when someone sends you a legal notice.

A doctor may renew professional indemnity insurance every year without giving much thought to it. Then a complaint or legal notice arrives. Suddenly, the important questions are not, “How much did I pay?” but, “What exactly is covered? Who do I notify? What happens next?”

That is why choosing professional indemnity insurance for doctors should involve more than comparing premiums.

What Should Doctors Actually Check?

1. Sum insured and limits

The sum insured, or limit of indemnity, should make sense for your specialty and professional exposure. Published Indian PI policies commonly distinguish between limits applying to individual incidents and the policy year.

A surgeon handling higher-risk procedures may need a different level of protection from a doctor with a very different practice profile.

2. What actually counts as a covered claim?

Read the policy wording, not just the brochure. Check the definition of a claim, covered professional services, exclusions, retroactive provisions and conditions.

For example, New India states that its professional indemnity policy covers civil liability arising from errors or omissions in professional services, subject to its terms. It also states that criminal liability is not covered.

That distinction matters.

3. Legal and medico-legal support

Financial indemnification is only one part of the picture. When a doctor receives a complaint, notice or summons, practical questions follow: Whom should I inform? What documents are needed? How should the matter proceed?

Some policies provide defence costs, subject to their terms and conditions. United India, for example, specifies defence costs and prior consent requirements in its published wording.

The availability and scope of legal or medico-legal assistance, however, can vary by provider and policy.

4. Understand the claims process

Do not wait until a dispute escalates to find the claims contact.

Published Indian policy documents commonly require prompt notification of an event that may give rise to a claim and submission of legal notices or summonses.

Ask before buying: Who do I contact, what documents should I preserve, and what are the reporting requirements?

5. Read the exclusions

The exclusions section deserves as much attention as the coverage section. Look for exclusions, deductibles, limits, conditions and reporting requirements.

Never assume that “professional indemnity” automatically means every legal or professional problem is covered.

6. Match the policy to your practice

A gynaecologist, anaesthetist, radiologist, surgeon and general physician may have very different professional exposures. Your policy should reflect the work you actually perform.

The NMC also expects registered medical practitioners to exercise professional judgment, communicate clearly and consult other health professionals when required for patient benefit.

7. Look beyond the policy document

When trouble starts, accessibility matters. Consider whether the provider offers meaningful claims assistance, medico-legal guidance and a clear escalation process.

Where APEX Fits In

APEX Risk Management and Professional Indemnity Services approaches PI as part of broader risk management for doctors.

Its focus includes professional indemnity solutions, doctor education, medico-legal awareness, risk prevention and support during claims or difficult legal situations, subject to the applicable policy terms and engagement.

The objective is not simply to help a doctor buy a policy. It is to help doctors better understand the risks they face and be better prepared when a complaint or claim arises.

The Better Question to Ask

The cheapest PI policy for doctors is not automatically the best value.

Before buying or renewing professional indemnity insurance in India, ask:

“When I actually need protection, do I understand what this policy covers, what it excludes, whom I contact, and what support is realistically available?”

That question can be far more valuable than simply asking for the lowest premium.
