Facts in nutshell:
The accused person who are notorious, on 24.09.2022 with intention to extort money from complainant illegally trespassed the hospital of complainants along with 30-40 people and started creating nuisance, misbehaving, threaten and using flighty language to complaint his wife and other staff of the hospital including female staff and demanded money from the complaint, else gave threats to defame the hospital and drag them into false and fabricated legal cases. The patients in the hospital were effected and disturbed by the nuisance and violence of the accused.
The accused persons defamed the complaint on social media and society also through various means on false and fabricated facts.
The police did not filed the FIR for the said incident hence the complainant doctor (AICL member) filed an application u/s 156(3) Crpc for order of registering FIR and investigation.
The court opined that prima facie case is made out for taking cognizance but without proper investigation nothing can be ruled out, hence court accepted the application and order the concern police in charge to investigate the matter.
