Hospitals and the doctors should always be well equipped and ready with their experts who can provide a shield to them, to handle the emergency situation and it’s after effects. One of the recently scenario in Bihar, where AICL members were caught into such situation. The Situation was managed only because APEX is a risk management company having experts and PAN India infrastructure and good approach to handle such situation.
Facts of the matter in Nutshell:
A nine months pregnant women was brought in a hospital in a deteriorated and dying-dying condition, the patient gave birth to a stillborn child, her condition was not good and hence hysterectomy was the need of the situation. The condition and need for hysterectomy was explained to patient’s husband but patient party did not give the approval as they wanted another child. The patient was treated accordingly and was shifted to general ward but her condition deteriorated late night, her vitals and BP were down. The gynaecologist (AICL member) who operated her rushed to the hospital and treated her but the patient succumbed to death at around 5 A.M.
In fit of rage patient party along with a group of 100 people started created nuisance, damaged hospital property, manhandled hospital staff and doctors.
Doctors called APEX, the medico legal experts guided the doctors on documentation part, the backend team of APEX allocated advocate in the vicinity who rushed to hospital, sought assistance of police, who removed the mob by applying forces.
Now the executives and allocated advocate console the patient party and an amicable meeting was arranged, Patient party was explained the medical complication and the treatment given to deceased patients, the rights of doctors and the law applicable for mob attack, how doctors can file FIR against and recover the damages.
The patient party understood that there is no negligence on part of treating doctors and how they can caught into litigation for breaking the law, patient party tendered unconditional apology and matter was settled.
